{"id":1305,"date":"2020-01-17T16:15:47","date_gmt":"2020-01-17T15:15:47","guid":{"rendered":"http:\/\/cfdt-spie.com\/?p=1305"},"modified":"2020-01-18T11:10:48","modified_gmt":"2020-01-18T10:10:48","slug":"courrier-de-lintersyndicale-spie-infoservices","status":"publish","type":"post","link":"https:\/\/cfdt-spie.com\/?p=1305","title":{"rendered":"Courrier de l&rsquo;intersyndicale SPIE infoservices"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Monsieur le Pr\u00e9sident de SPIE\nInfoservices,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Alors que des repr\u00e9sentants des\nOrganisations Syndicales \u00e9taient en train de distribuer un tract intersyndical\n(CFDT-CFTC-CFE-FO-CGT), le vendredi 10 janvier 2020, &nbsp;dans le Hall\nd\u2019entr\u00e9e du b\u00e2timent Tangram (partie commune au diff\u00e9rentes soci\u00e9t\u00e9s) \u00e0 Malakoff,\nvous leur avez express\u00e9ment demand\u00e9 de sortir du b\u00e2timent en tenant les propos\nsuivant&nbsp;:&nbsp;\u00ab&nbsp;Vous n\u2019avez pas le droits de tracter dans l\u2019enceinte\ndu b\u00e2timent, si vous voulez le faire&nbsp; faites-le dehors&nbsp;\u00bb. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tract dont nous vous avons remis\nun exemplaire, avant de nous ex\u00e9cuter et de sortir afin de respecter votre\nordre. <\/p>\n\n\n\n<h6 class=\"has-grey-color has-text-color wp-block-heading\">Nous nous permettons de vous rappeler\nque&nbsp;: <\/h6>\n\n\n\n<h6 class=\"has-text-color wp-block-heading\" style=\"color:#e75c21\"><strong>&#8211;&nbsp;l\u2019Article L.&nbsp;2142-4 &#8211; Code du Travail&nbsp; (Ordonnance n\u00b0&nbsp;2007-329 du 12&nbsp;mars 2007) portant sur la Diffusion des tracts syndicaux indique que \u00ab&nbsp;Les publications et tracts de nature syndicale peuvent \u00eatre librement diffus\u00e9s aux travailleurs de l&rsquo;entreprise dans l&rsquo;enceinte de celle-ci aux heures d&rsquo;entr\u00e9e et de sortie du travail.&nbsp;\u00bb <\/strong><\/h6>\n\n\n\n<p class=\"wp-block-paragraph\">-A partir du moment o\u00f9 la\ndistribution a lieu en dehors de l\u2019entreprise, qu\u2019il s\u2019agisse de la voie\npublique, des parties communes de l\u2019immeuble ou encore des locaux de\nl\u2019entreprise cliente au sein desquels les salari\u00e9s de l\u2019entreprise effectuent\ndes missions [Cass. soc., 18 janv. 2011, n\u00b0 09-12.240]. Ainsi, un hall d\u2019immeuble\npartie commune constitue un lieu de libre diffusion des tracts syndicaux. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nous esp\u00e9rons sinc\u00e8rement que\ncette situation ne doit plus se reproduire.
