{"id":1536,"date":"2020-02-26T16:43:00","date_gmt":"2020-02-26T15:43:00","guid":{"rendered":"http:\/\/cfdt-spie.com\/?p=1536"},"modified":"2020-04-28T16:46:43","modified_gmt":"2020-04-28T14:46:43","slug":"rupture-conventionnelle-la-violence-morale-engendree-par-le-harcelement-vicie-la-convention-2","status":"publish","type":"post","link":"https:\/\/cfdt-spie.com\/?p=1536","title":{"rendered":"Rupture conventionnelle : la violence morale engendr\u00e9e par le harc\u00e8lement vicie la convention"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Publi\u00e9 le 26\/02\/2020 Par Service juridique-CFDT<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le contexte de harc\u00e8lement moral dans lequel a \u00e9t\u00e9 sign\u00e9e une rupture conventionnelle peut engendrer une situation de violence morale constitutive d\u2019un vice du consentement entra\u00eenant la nullit\u00e9 de la rupture. <em>Cass.soc.29.01.20, n\u00b018-24296.<\/em><\/p>\n\n\n\n<figure class=\"wp-block-image is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.cfdt.fr\/upload\/docs\/image\/png\/2017-01\/picto_rupture_accord-blanc.png\" alt=\"PICTO Rupture accord-Blanc\" width=\"170\" height=\"170\" title=\"PICTO Rupture accord-Blanc\"\/><\/figure>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Faits, proc\u00e9dure, pr\u00e9tentions<\/strong><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A son retour de cong\u00e9 de maternit\u00e9, une vendeuse, responsable de magasin, subit un&nbsp; &nbsp; &nbsp; contexte&nbsp;difficile, propre \u00e0 caract\u00e9riser un harc\u00e8lement moral (r\u00e9trogradation et promotion d\u2019un&nbsp; &nbsp;coll\u00e8gue \u00e0 ses fonctions de responsable, propos misogynes, expression du souhait de la voir quitter l\u2019entreprise\u2026) et se retrouve en arr\u00eat maladie, suivie par une psycholoque du fait de cette&nbsp; situation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finalement, elle signe une rupture conventionnelle avec son employeur et cette rupture est homologu\u00e9e par la Direccte.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Puis, <strong>consid\u00e9rant que son consentement a \u00e9t\u00e9 vici\u00e9 du fait du harc\u00e8lement moral qu\u2019elle estime avoir subi, elle saisit la juridiction prud\u2019homale d\u2019une demande en nullit\u00e9 de la rupture conventionnelle pour harc\u00e8lement moral.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La cour d\u2019appel accueille sa demande, condamne l\u2019employeur en raison du harc\u00e8lement et annule la rupture, qu\u2019elle requalifie en licenciement nul.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019employeur d\u00e9cide alors de se pourvoir en cassation, principalement au motif que le harc\u00e8lement moral ne constitue pas en soi une cause de nullit\u00e9 de la rupture conventionnelle.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Une situation de violence morale vicie le consentement \u00e0 la RC<\/strong><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation rejette le pourvoi de mani\u00e8re lapidaire.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Haute juridiction approuve en effet les juges du fond d\u2019avoir consid\u00e9r\u00e9 que<strong> la rupture conventionnelle est nulle d\u00e8s lors<\/strong> qu\u2019ils ont relev\u00e9 qu\u2019\u00e0 la date de la signature de la convention, \u00ab&nbsp;<strong><em>la salari\u00e9e \u00e9tait dans une situation de violence morale en raison du harc\u00e8lement moral et des troubles psychologiques qui en sont d\u00e9coul\u00e9s<\/em><\/strong>&nbsp;\u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Elle ajoute que les juges ont ainsi \u00ab&nbsp;<strong><em>caract\u00e9ris\u00e9 un vice du consentement<\/em><\/strong>&nbsp;\u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La rupture conventionnelle met fin au contrat de travail d\u2019un commun accord entre l\u2019employeur et le salari\u00e9. Ce mode de rupture est r\u00e9gi par les articles L.1237-11 et suivants du Code du travail, ainsi que par le droit commun des conventions. C\u2019est pourquoi, la RC, qui doit \u00eatre soumise au Direccte pour homologation, ne peut \u00eatre contest\u00e9e devant le juge qu\u2019en raison d\u2019un vice du consentement.
