Il r\u00e9sulte de l\u2019article L 3171-4 du Code du travail<\/a> qu’en cas de litige relatif \u00e0 l’existence ou au nombre d’heures de travail<\/strong> accomplies, il appartient au salari\u00e9 de pr\u00e9senter, \u00e0 l’appui de sa demande, des \u00e9l\u00e9ments suffisamment pr\u00e9cis quant aux heures non r\u00e9mun\u00e9r\u00e9es qu’il pr\u00e9tend avoir accomplies afin de permettre \u00e0 l’employeur, qui assure le contr\u00f4le des heures de travail effectu\u00e9es, d’y r\u00e9pondre utilement en produisant ses propres \u00e9l\u00e9ments. Le juge forme sa conviction en tenant compte de l’ensemble de ces \u00e9l\u00e9ments au regard des exigences rappel\u00e9es aux dispositions l\u00e9gales et r\u00e9glementaires pr\u00e9cit\u00e9es. Apr\u00e8s analyse des pi\u00e8ces produites par l’une et l’autre des parties, dans l’hypoth\u00e8se o\u00f9 il retient l’existence d’heures suppl\u00e9mentaires, il \u00e9value souverainement, sans \u00eatre tenu de pr\u00e9ciser le d\u00e9tail de son calcul, l’importance de celles-ci et fixe les cr\u00e9ances salariales s’y rapportant.\u00a0Viole ce texte la cour d\u2019appel qui, pour d\u00e9bouter le salari\u00e9 de sa demande au titre des heures suppl\u00e9mentaires et des cong\u00e9s pay\u00e9s aff\u00e9rents, retient que le salari\u00e9 verse aux d\u00e9bats des tableaux de type Word<\/strong> par lesquels il a r\u00e9capitul\u00e9 ses heures<\/strong> suppl\u00e9mentaires non v\u00e9rifiables sans verser d’autres \u00e9l\u00e9ments les corroborant, sachant que travaillant \u00e0 domicile<\/strong> avant son recadrage, il n’\u00e9tait pas contr\u00f4l\u00e9 dans ses heures de travail et de pause et en d\u00e9duit que le salari\u00e9 ne fournit par cons\u00e9quent pas les \u00e9l\u00e9ments suffisants pour \u00e9tayer sa demande d’heures suppl\u00e9mentaires (Cass. soc. 8-7-2020 n\u00b0 18-26.385 F-D)<\/p>\n","protected":false},"excerpt":{"rendered":"
