Selon les articles L 1471-1<\/a> et L 1245-1<\/a> du Code du travail, dans leur r\u00e9daction ant\u00e9rieure \u00e0 l\u2019ordonnance 2017-1387 du 22 septembre 2017, toute action portant sur l’ex\u00e9cution du contrat de travail<\/strong> se prescrit par deux ans \u00e0 compter du jour o\u00f9 celui qui l’exerce a connu ou aurait d\u00fb conna\u00eetre les faits lui permettant d’exercer son droit. En application de l\u2019article L 1242-1<\/a> du m\u00eame Code, par l’effet de la requalification des CDD<\/strong>, le salari\u00e9 est r\u00e9put\u00e9 avoir occup\u00e9 un emploi \u00e0 dur\u00e9e ind\u00e9termin\u00e9e depuis le jour de son engagement par un CDD irr\u00e9gulier. Il en r\u00e9sulte que le d\u00e9lai de prescription <\/a>d’une action en requalification d’un CDD en contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e fond\u00e9e sur le motif du recours au CDD \u00e9nonc\u00e9 au contrat a pour point de d\u00e9part le terme du contrat ou, en cas de succession de CDD, le terme du dernier contrat et que le salari\u00e9 est en droit, lorsque la demande en requalification est reconnue fond\u00e9e, de se pr\u00e9valoir d’une anciennet\u00e9 <\/a>remontant au premier contrat irr\u00e9gulier (Cass. soc. 8-7-2020 n\u00b0 18-19.727 F-D).<\/p>\n","protected":false},"excerpt":{"rendered":"
