Par ailleurs, l&rsquo;acceptation de la modification du contrat de travail ne peut r\u00e9sulter que d&rsquo;une manifestation claire et non \u00e9quivoque de volont\u00e9 et ne peut se d\u00e9duire d&rsquo;un acquiescement implicite. D\u00e8s lors, le <strong>juge des r\u00e9f\u00e9r\u00e9s<\/strong> ne peut pas se d\u00e9clarer incomp\u00e9tent pour conna\u00eetre des demandes d&rsquo;un salari\u00e9 de condamner son employeur \u00e0 le r\u00e9affecter \u00e0 son poste et \u00e0 lui fournir un travail en lien avec ses fonctions ainsi qu\u2019\u00e0 lui payer une certaine somme \u00e0 titre provisionnel au motif, notamment, que\u00a0int\u00e9ress\u00e9 a attendu plusieurs mois avant de saisir la formation de r\u00e9f\u00e9r\u00e9, alors qu&rsquo;il avait constat\u00e9 que le salari\u00e9 n&rsquo;avait pas donn\u00e9 son accord expr\u00e8s \u00e0 la modification de son contrat de travail (Cass. soc. 14-10-2020 n\u00b0 19-14.182 F-D).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La modification du contrat de travail d&rsquo;un salari&eacute; impos&eacute;e sans son accord est de nature &agrave; caract&eacute;riser un trouble manifestement illicite.
