Il doit s\u2019abstenir de toute demande de pr\u00e9cision sur un dossier ou pour le suivi d\u2019un client, par tout moyen (mail, appel t\u00e9l\u00e9phonique, SMS, etc.).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le fait qu\u2019un employeur proc\u00e8de \u00e0 une telle sollicitation r\u00e9v\u00e8le un manquement de sa part \u00e0 son obligation de s\u00e9curit\u00e9 (Code du travail, art. L. 4121-1).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Par ailleurs, si l\u2019arr\u00eat de travail est en lien avec ses conditions de travail (burn-out, harc\u00e8lement, etc.), la seule \u00e9vocation de l\u2019environnement professionnel peut \u00eatre mal v\u00e9cue par le salari\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cependant un employeur peut contacter un salari\u00e9 pour exiger la restitution des outils de travail mis \u00e0 sa disposition ou la communication de toute information n\u00e9cessaire \u00e0 l\u2019activit\u00e9 de l\u2019entreprise en son absence (documents, codes d\u2019acc\u00e8s, etc.).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Par ailleurs, si les circonstances et les relations le permettent, il est possible de le contacter pour prendre des nouvelles et maintenir le lien avec les coll\u00e8gues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En outre, depuis la loi sant\u00e9 du 2 ao\u00fbt 2021, l\u2019employeur doit informer par tout moyen les salari\u00e9s absents depuis plus de 30 jours de la possibilit\u00e9 de b\u00e9n\u00e9ficier d\u2019un rendez-vous de liaison.
